Refund Eligibility

Understanding When Refunds Are Available

Project Initiation Fee:

There is a mandatory one-hour, $150 project initiation fee for any and all projects and purchases. This fee covers the resources, planning, and time invested in initiating your project, including:

  • Initial consultation and project planning
  • Account setup and configuration
  • IDX integration preparation
  • Resource allocation and team assignment

Any and all refunds will incur a $150 deduction, with no exceptions.

No Refunds After Project Review

Once the project has been sent to you for review, we cannot offer a refund. At this stage, substantial time, effort, and resources have been invested in designing and developing your new construction website according to the specifications provided.

This includes website design, IDX integration, content population, city/development pages, and all customizations requested during the project kickoff phase.

Revisions and Modifications:

We offer a set number of revision rounds, as specified in your pricing package (Starter, Most Popular, or Dominate), to ensure that the final output aligns with your expectations. We strongly encourage you to:

  • Review all deliverables thoroughly during revision rounds
  • Communicate any necessary changes or adjustments promptly
  • Utilize your allocated revision rounds to refine the website
  • Ask questions if anything is unclear or doesn't meet your expectations

Non-Refundable Circumstances

Situations Where Refunds Are Not Available

1. Non-Responsive Clients:

If a client becomes non-responsive for a duration of 30 days or more after the initiation of the project, the project will be considered abandoned. No refunds will be provided for abandoned projects.

This policy ensures that our team's time and resources are not indefinitely allocated to stalled projects. We encourage active communication throughout the project lifecycle.

2. IDX Platform Access Issues:

The client bears sole responsibility for establishing and maintaining access to the IDX platform (New Home Source, Real Geeks, CINC, Sierra Interactive, or Lofty). Failure to provide valid account credentials or administrative access will preclude any refund eligibility.

This includes:

  • Not providing valid username and password for IDX platforms
  • Not granting administrative access to required accounts
  • Not maintaining active subscriptions to required third-party services
  • Terminating IDX platform subscriptions before project completion

3. Third-Party Services:

Any third-party services or products purchased as part of your project (domain registration, New Home Source Professional account, payment processing fees, etc.) are non-refundable and are subject to the terms and conditions of those third-party providers.

4. Monthly Subscription Fees:

The $199/month Smart Agent Suite subscription is billed monthly and is non-refundable. If you cancel your subscription, you will retain access until the end of your current billing period, but no prorated refunds will be issued for partial months.

How to Request a Refund

If you believe you qualify for a refund under the terms of this policy, please follow these steps:

  1. Submit the Refund Form below and provide:
    • Your full name and account information
    • Project details (package purchased, date of purchase)
    • A clear and detailed explanation of why you are requesting a refund
    • Any relevant documentation or correspondence
  2. Review Process: Our team will review your request carefully, considering:
    • The work completed and deliverables provided
    • Communications exchanged between our team and you
    • Adherence to the terms outlined in this Refund Policy
    • Project timeline and your level of engagement
  3. Response: We will respond to your refund request within 5 business days with either:
    • Approval of your refund request
    • A request for additional information
    • An explanation if your request does not qualify under this policy
  4. Processing: If your refund request is approved, the refund (minus the $150 project initiation fee) will be processed back to your original method of payment within 10 business days.

Site Transfers & Platform Termination

Critical Information About Website Ownership

Important: Your website design is built on and tied to your chosen IDX platform.

What Happens If You Terminate Your IDX Platform Subscription

If you terminate your subscription to your IDX platform (New Home Source, Real Geeks, CINC, Sierra Interactive, or Lofty):

  • Your design does NOT transfer with you to a new platform
  • You lose all pages and data created on those pages
  • Your website will no longer be accessible
  • No refund will be provided for the design work completed

Why This Matters:

We build your new construction website using the infrastructure and tools provided by your chosen IDX platform (New Home Source, Real Geeks, CINC, Sierra Interactive, or Lofty). The website design, layouts, pages, and functionality are integrated with and dependent on that specific platform's technology.

When you terminate your subscription to the IDX platform, you lose access to the entire platform—including your custom-designed website.

What You Can Save:

You are welcome to copy and paste any custom content you have added to your website (text, descriptions, blog posts, etc.) to another platform or document. However:

  • You must do this BEFORE terminating your IDX platform subscription
  • You cannot export the design, layout, or structure of the website
  • You cannot transfer integrations, automations, or custom functionality
  • Images, videos, and media files should be downloaded before cancellation

Our Recommendation:

Before committing to a platform, ensure you are comfortable with the long-term relationship. If you anticipate changing platforms in the future, discuss this with our team during your consultation. We can advise on the best strategy for your specific situation.

Limitations and Exclusions

Policy Scope:

  • This Refund Policy applies exclusively to web design and development services provided by Smart Agent Tech
  • Refunds are only processed back to the original method of payment used for the initial transaction
  • We cannot issue refunds to third parties or alternative payment methods

Third-Party Services:

Any third-party services or products purchased as part of your project are governed by the refund policies of those respective providers. Smart Agent Tech is not responsible for refunds related to:

  • Domain registrations (GoDaddy, Namecheap, Google Domains, etc.)
  • IDX platform subscriptions (New Home Source, Real Geeks, CINC, Sierra, Lofty)
  • Payment processing fees
  • Third-party integrations or software

Time Limits:

Refund requests must be submitted within 30 days of project initiation and before the project has been delivered for your review. Refund requests submitted after this window will not be eligible for consideration.

Dispute Resolution:

If you disagree with a refund decision, you may request a secondary review by emailing our management team at [email protected] with "Refund Dispute" in the subject line. We will conduct a thorough secondary review within 10 business days.

Changes to This Refund Policy

Smart Agent Tech reserves the right to update or modify this Refund Policy at any time. Changes will be effective immediately upon posting to this page with an updated "Effective Date" at the top.

We encourage you to review this Refund Policy periodically. Your continued use of our services after any changes indicates your acceptance of the updated policy.

For significant policy changes, we will make reasonable efforts to notify active clients via email.
